Welcome to emx.lk, a fully owned venture of EMAX, a computer store providing laptop spare parts and services in Ambalangoda, Sri Lanka. By accessing or using the Site, you agree to these Terms and Conditions. Please review them carefully. EMAX may modify these terms at any time, and your continued use of the Site means you accept the changes.

General Use and Electronic Communication

Your use of the Site is governed by these Terms and our Privacy Policy. When you visit the Site or send us emails, you consent to receive communications from us electronically, via email or notices posted on the Site. You agree that all electronic communications satisfy any legal requirement that such communication be in writing.

Site Access and Restrictions

EMAX grants you a limited, non-exclusive license to access and make personal, non-commercial use of the Site. This license strictly prohibits commercial resale, duplication, or exploitation of the Site's content, including product listings, descriptions, or prices. Using data mining tools, robots, or framing techniques to enclose EMAX proprietary information without express written consent is forbidden. Any unauthorized use terminates the permission granted.

Your Account Responsibilities

If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You are liable for all activities conducted under your account. You must immediately notify EMAX of any unauthorized use of your account. EMAX will not be responsible for any loss due to others using your account without your knowledge, though you may be liable for losses incurred by EMAX or others resulting from unauthorized use. While we sell products for children, we sell only to adults who can purchase with a valid payment method. EMAX reserves the right to refuse service, terminate accounts, or cancel orders at its discretion.

Product Information, Pricing, and Risk

Product Descriptions: EMAX attempts to be as accurate as possible. However, we do not warrant that product descriptions or other Site content are entirely accurate, complete, current, or error-free. If a product you purchase is not as described, your sole remedy is to return it in unused condition to the relevant vendor. Buyers are responsible for ensuring the fitness of products and services for their intended purpose.

Pricing: The listed price may not always represent the full retail price. We do not confirm the price of an item until you order. If an item’s actual price is higher than the stated price, we will contact you for instructions before proceeding with or canceling the order. All prices are listed in Sri Lankan Rupees (LKR).

Risk of Loss: All purchases are made pursuant to a delivery contract, meaning the risk of loss and title for items pass to you upon our delivery to the carrier.

Returns, Refunds, and Cancellations

Refunds will only be considered if the product specifications differ significantly from those stated on the Site, and such arrangements must be negotiated directly with EMAX. We do not process standard refunds or returns via the Site. Order cancellations are possible only before payment is processed; once payment is completed, no cancellations are accepted.

Warranty Disclaimer and Liability Limitation

This Site and all its content, materials, products, and services are provided by EMAX on an "as is" and "as available" basis without any express or implied warranties. Your use of this Site is at your sole risk. EMAX disclaims all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose. EMAX does not warrant that the Site, content, or emails are free of viruses or other harmful components. EMAX will not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use of this Site or any products or services included on it.

Governing Law and Disputes

The Site and these Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka. You agree that the laws of Sri Lanka will govern all matters related to the Site. Any dispute or legal proceeding concerning these Terms or your visit to the Site shall be governed by the Arbitration Act No. 11 of 1995 in Sri Lanka. Any claim must be commenced within one year after the cause of action arises, or it is barred.

Policy Changes

We reserve the right to make changes to our Site, policies, and these Terms and Conditions at any time. If any provision in these Terms is deemed void or unenforceable, that provision shall be severed, and the validity of the remaining provisions shall not be affected.
